Standard Terms and Conditions for App

Udaipur Smart City Limited (hereinafter referred to as "USCL," "We," "Us," or "Our"), a Government of Rajasthan Company, is launching a mobile application (hereinafter referred to as the "App") to facilitate the public of Udaipur and other users (hereinafter referred to as "You," "Your," or "User") in making reservations for various tourist places, including those belonging to third-party service providers, and to make payments for these services.

These Terms and Conditions ("Terms") govern Your use of the App and its services. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If You do not agree with any part of these Terms, you must not use the App.

1.About the App

1.1   The App provides a platform for Users to discover information about tourist places in and around Udaipur, check availability, make reservations, and process payments for entry tickets, activities, and other services offered by USCL or third-party operators.

1.2   USCL acts as a facilitator, connecting Users with various tourist attractions and service providers. For services provided by third parties, USCL is an intermediary and is not responsible for the provision or quality of those services.

2. User Accounts and Responsibilities

2.1 To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 You are responsible for safeguarding Your account password and for any activities or actions under Your account. You agree to notify USCL immediately of any unauthorized use of Your account.

2.3 You must be at least 18 years of age to create an account and make reservations through the App. Users below 18 years may use the App under the supervision of a parent or legal guardian.

2.4 You agree to use the App in compliance with all applicable local, state, national, and international laws, rules, and regulations.

3. Booking and Reservation Policy

3.1   Availability: All bookings are subject to availability. USCL does not guarantee the availability of any particular tourist place or service until the booking is confirmed.

3.2   Confirmation: A booking is considered confirmed only after successful payment and receipt of a confirmation notification or voucher through the App or registered email/mobile number.

3.3   Accuracy of Information: You are responsible for ensuring the accuracy of all information provided during the booking process, including dates, number of visitors, and contact details. USCL will not be liable for any errors or losses arising from incorrect information provided by You.

3.4   Entry Requirements: You are responsible for adhering to any specific entry requirements, timings, rules, and regulations stipulated by the respective tourist place or third-party operator.

3.5   Third-Party Services: For bookings related to services provided by third-party operators, their specific terms and conditions will also apply. USCL will endeavour to make these terms available, but it is Your responsibility to review and comply with them. USCL is not a party to Your agreement with the third-party operator and disclaims all liability arising from such agreements.

4.Payment Terms

4.1   Pricing: Prices for services listed on the App are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice, but changes will not affect bookings already confirmed.

4.2   Payment Methods: The App will support various payment methods, including credit/debit cards, net banking, and UPI, through integrated third-party payment gateways.

4.3   Payment Authorization: By making a payment, you authorize USCL and its designated payment gateway to charge the specified amount to Your selected payment method.

4.4   Payment Security: USCL will take reasonable measures to ensure the security of Your payment information. However, USCL is not liable for any unauthorized access or use of Your payment information by third parties, including payment gateways. You are advised to review the terms and conditions of the respective payment gateway.

4.5   Transaction Failures: In case of a payment failure, USCL will not be responsible for any loss or damage. It is Your responsibility to ensure that sufficient funds are available in Your account and that the payment details are entered correctly.

5. Cancellations and Refunds

5.1   Cancellation Policy: The cancellation policy for each booking will be clearly displayed at the time of booking and may vary depending on the tourist place and/or the third-party operator.

5.2 Refunds:

5.3   No-Shows: Failure to arrive at the tourist place at the designated time (no-show) may result in forfeiture of the entire booking amount, as per the applicable policy.

6. Intellectual Property

6.1 The App, its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by USCL, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for Your personal, non-commercial use in accordance with these Terms. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as incidentally necessary to use the App.

7. Privacy Policy

7.1 USCL is committed to protecting Your privacy. Our Privacy Policy, which is incorporated into these Terms by reference, explains how We collect, use, and disclose Your personal information. By using the App, you consent to the collection and use of Your information as described in the Privacy Policy.

7.2 The Privacy Policy will be available within the App and on the USCL website.

8. User Conduct

8.1 You agree not to use the App in any way that:

8.2 Violates any applicable law or regulation.

8.3 Is fraudulent, false, misleading, or deceptive.

8.4 Infringes on the rights of others, including intellectual property rights.

8.5 Is defamatory, obscene, pornographic, vulgar, or offensive.

8.6 Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.

8.7 Is violent or threatening or promotes violence or actions that are threatening to any other person.

8.8Attempts to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.

8.9Introduces any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

9. Disclaimer of Warranties

9.1The App and its services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

9.2USCL does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9.3USCL makes no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content obtained through the App, including information related to tourist places and third-party services. You are solely responsible for verifying such information.

10. Limitation of Liability

10.1To the fullest extent permitted by applicable law, in no event will USCL, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

10.2Your access to or use of or inability to access or use the App.

10.3Any conduct or content of any third party on the App, including third-party service providers.

10.4Any content obtained from the App.

10.5Unauthorized access, use, or alteration of Your transmissions or content.

10.6The provision or failure to provide any service by a third-party operator.

10.7USCL's total liability to You for all claims arising out of or relating to the use of or inability to use the App or its services, whether in contract, tort, or otherwise, shall not exceed the amount paid by You, if any, for accessing the App or for the specific booking giving rise to the claim.

10.8USCL, being a Government of Rajasthan Company, undertakes its role with a commitment to public service. However, the limitations of liability stated herein are essential to its ability to provide this App and its services.

11.Indemnification

11.1You agree to defend, indemnify, and hold harmless USCL, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to Your violation of these Terms or Your use of the App, including, but not limited to, any use of the App's content, services, and products other than as expressly authorized in these Terms or Your use of any information obtained from the App.

12. Modification of Terms

12.1USCL reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

12.2By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the App.

13. Termination

13.1USCL may terminate or suspend Your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if You breach the Terms.

13.2Upon termination, your right to use the App will immediately cease. If You wish to terminate Your account, you may simply discontinue using the App or contact USCL for assistance.

14. Governing Law and Jurisdiction

14.1These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

14.2Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in Udaipur, Rajasthan, India.

15.2 Users can submit their grievances with respect to the App, its services, or these Terms to the Grievance Officer.

16. Severability

16.1 If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Waiver

17.1 No waiver by USCL of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of USCL to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Entire Agreement

18.1 These Terms, together with our Privacy Policy and any other legal notices published by USCL on the App, shall constitute the entire agreement between You and USCL concerning the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, concerning the App.
